Additionally, the Employee Retirement Income Security Act (ERISA) allows qualified retirement savings to be divided between divorcing couples. Alimony is not taxable income according to the guidelines established by the IRS, and under federal law, debts for alimony and child support cannot be discharged in bankruptcy. An ex-spouse can continue to have health insurance through COBRA.

Once both parties have signed a divorce settlement agreement and expressed satisfaction with it, the agreement is given to the family court judge assigned to the case. The divorce settlement agreement lays out all the arrangements between divorcing spouses, including their intentions for settling their divorce and the grounds for their divorce. The settlement agreement will likely be accepted by the judge and incorporated into the final divorce decree, which becomes legally binding once the court includes the agreement in it.
